HANDLING CONTESTED AND UNCONTESTED DIVORCE
There are several types of divorce, and the simplest and least expensive is a no-fault or uncontested divorce. This form of divorce is when the two parties are generally in agreement in all the pertinent matters of the marriage dissolution, including the division of assets and debts, child custody, any support issues or other matter that must be fully resolved.
When the two parties are able to work these issues out in advance, it allows them to avoid a costly trial and the trouble and emotional upheaval of a contested divorce. There are some cases in which mediation can get all these issues under control and resolved, allowing the matters to be settled without the intervention of the court.
When this is not possible, as the two former partners cannot come to a compromise, completely disagree about issues such as support and custody, it is necessary to litigate the matter in court. Some people who are involved in a divorce make unreasonable demands, or are too emotionally involved in the process to come to a resolution through mediation or negotiation with their attorney. In such cases, we are very adept in the process of presenting a case in court, and fighting for our clients' interests and future.
